The Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN), has stated that the Edo State House of Assembly does not have the constitutional authority to suspend elected chairmen and vice chairmen of local governments in the state.

Fagbemi made this assertion on Thursday, emphasizing that, based on his understanding of the situation, it was unlawful for the state’s House of Assembly to take such action. While acknowledging that he had limited information on the specific political issues surrounding the case in Edo State, the Minister clarified that it was beyond the powers of a state House of Assembly to suspend duly elected local government officials.

“The facts of the case are still unclear, but it is unlawful for any state House of Assembly to suspend elected local government officials,” Fagbemi stated, according to The Nation.

He further explained that under the Nigerian Constitution, the only body authorized to exercise such powers over local government leaders is the legislative arm at the local government level itself, not the state legislature.

Background to the Suspension

This statement from the AGF comes in response to the Edo State House of Assembly’s recent actions, where, on Tuesday, the Assembly passed a resolution suspending the chairmen and vice chairmen of all 18 local government areas in the state for two months. In addition to the suspension, the Assembly directed the leaders of the local government legislative arms to take over the leadership of their respective councils for the duration of the suspension.

In defense of the suspension, Andrew Emwanta, the Special Adviser to Governor Godwin Obaseki on Legal Matters, argued that the suspension was in accordance with the Constitution. Speaking in an interview on Wednesday, Emwanta emphasized that similar actions had been taken by previous governors of the state, including Adams Oshiomhole and Godwin Obaseki, during their respective tenures, when local government chairmen were also suspended.
