Ejimakor explained that Justice Nyako’s recusal order from September 24, 2024, still stands and remains binding, emphasizing that no court has set aside the order. He further accused the prosecution of attempting to mislead the court, asserting that Kanu no longer has a case to answer before Justice Nyako.
Kanu, who faces seven counts of treasonable felony and terrorism, has denied all charges. He was first arrested in 2015 after returning to Nigeria and was granted bail in 2017 due to health concerns. However, after fleeing the country following a military raid on his home, Kanu was re-arrested in Kenya in 2021 and extradited back to Nigeria, where he remains in detention under the Department of State Services (DSS).TOP SECRET REVEALED! At the last court session on September 24, 2024, Kanu requested that Justice Nyako recuse herself, citing a lack of confidence in her handling of the case. Justice Nyako initially agreed to recuse herself and forwarded the case to the Chief Judge of the Federal High Court for reassignment. However, the Chief Judge returned the case to Justice Nyako, directing that Kanu must file a formal motion if he still wanted the judge to step aside.
Despite this, the Federal Government’s counsel, Adegboyega Awomolo (SAN), requested a new trial date, asserting that the Chief Judge’s decision had reinstated Justice Nyako as the trial judge.
