Jitoboh had previously filed a lawsuit against the PSC for his compulsory retirement, and though he passed away on Thursday, 27 December 2024, the court ruled in his favor on Monday, granting his prayers.
The ruling reinstated him with effect from the date of his purported retirement and awarded him N50 million in damages. Onu posted on X, “Today (Monday), DIG Moses A. Jitoboh wins his case against the Police Service Commission. Reinstated with effect from the date of his purported compulsory retirement and awarded 50m in general damages. Having passed on to glory, it is now official that he died in active duty to his fatherland.”
However, some reports mistakenly attributed Jitoboh’s forced retirement to President Tinubu and IGP Egbetokun, claiming it was done to make room for Egbetokun. On Tuesday, Onu issued a statement to correct these inaccuracies, stating that neither Tinubu nor Egbetokun had any role in Jitoboh’s dismissal.
Onu explained that Jitoboh’s compulsory retirement was solely the result of the actions of former IGP Solomon Arase, who was also serving as Chairman of the PSC at the time. The retirement, Onu said, was personal and arbitrary, and the matter was only addressed after Onu’s legal team, through the office of the Attorney General of the Federation, complained about Arase’s decision. He clarified, “It was 100% the handiwork of former IGP Solomon Arase as the Chairman of the Police Service Commission… The reason for his action was personal and very mundane, and he was sacked by President Bola Tinubu upon our complaint.”
Onu also revealed that both the IGP and the current PSC Chairman, Hashimu Argungu, were opposed to Jitoboh’s retirement and hoped for his return to the force following the court ruling. Onu remarked that the President had not acted on the issue at the time because it was already in court, and the Attorney General had advised waiting for the court’s decision.
Onu further emphasized that the retirement was not intended to favor the IGP, pointing out that other officers who were retired alongside Jitoboh did not challenge their dismissals due to their imminent retirements.What Is Your Opinion On This? He added, “If any President was unkind to Moses, it was Muhammadu Buhari who signed the Police Act, 2020 into law and flouted its provisions twice, simply to deny Moses his privileged lawful promotion to the office of IGP.”PROCEED WITH YOUR READING
