In a decision delivered on Friday, two out of three justices on the appellate panel determined that the Federal High Court had exceeded its authority by entertaining the case.

Justice Gabriel Omoniyi Kolawole, delivering the lead judgment, emphasized that issues concerning traditional chieftaincy disputes are within the exclusive jurisdiction of state high courts. He stated, “The Federal High Court has no business adjudicating over chieftaincy matters. Such issues are under the exclusive purview of state high courts.”

As a result, Justice Kolawole ordered that the matter be returned to the Kano State High Court for reassignment to a judge competent to hear and resolve the dispute.

However, this decision was not unanimous. The Presiding Justice, Mustapha Mohammed, and another member of the panel disagreed with Kolawole’s directive to remit the case for further hearing. Instead, the majority opinion held that the proper course of action was to strike out the case entirely.

“Given that the Federal High Court lacked jurisdiction from the onset, the proceedings should not be remitted but struck out,” the majority ruled, emphasizing that any action taken by a court lacking jurisdiction is null and void.

The judgment adds another layer to the contentious legal dispute involving the Kano Emirate, specifically the conflict between the current Emir, Ado Bayero, and his predecessor, Muhammadu Sanusi II. This oversight, according to the appellate court, denied Sanusi the opportunity to present his defense, thus compromising the fairness of the proceedings.
