This ruling came after Justice Maryann Anenih had previously rejected the former governor’s initial bail request on December 10, deeming it premature. At that time, she explained that the application was invalid because the defendant was neither in custody nor present in court.

However, the court provided Bello’s legal team with the opportunity to submit a revised bail application and request a hearing date. The former governor is facing serious allegations of money laundering, involving up to N110 billion, alongside two co-defendants. At the court hearing on Thursday, Joseph Daudu, SAN, representing Bello, informed the court that the defense had submitted an additional affidavit in response to the prosecution’s counter-affidavit. However, Daudu requested the withdrawal of this affidavit, stating, “We do not want to make the matter contentious.” The prosecution counsel, Olukayode Enitan, SAN, raised no objections to this request, and the court granted the withdrawal, dismissing the further affidavit.

Daudu also informed the court that he had been in discussions with the head of the prosecution team and had reached an agreement to expedite the trial process. With this in mind, Daudu urged the court to approve the bail application. He further requested that, if bail were granted, the court reconsider the bail conditions for all three defendants in the case. Specifically, he suggested that the properties eligible to serve as bail sureties should be expanded beyond Maitama to include other areas of the Federal Capital Territory (FCT), such as Jabi, Utako, Apo, Guzape, Garki, and Asokoro.

In response, prosecution counsel Olukayode Enitan confirmed that discussions had indeed taken place between Daudu and the prosecution team. Enitan reiterated the importance of cooperation between legal professionals, as long as it did not compromise the pursuit of justice. He emphasized that the decision to grant or deny bail ultimately rested with the court, and that both the defense and prosecution were leaving the matter to the discretion of Justice Anenih.

In her ruling, Justice Anenih acknowledged that the charges against the first defendant were such that bail could be granted. As a result, she approved Bello’s bail application, setting the amount at ₦500 million and requiring two sureties of equivalent value. These sureties must be prominent Nigerians with real estate in key areas of the Federal Capital Territory, including Maitama, Jabi, Utako, Apo, Guzape, Garki, and Asokoro.
