The ruling was issued by Justice Mohammed Zubairu after a motion was filed on behalf of Bodejo by his legal counsel, Senior Advocate of Nigeria (SAN) Reuben Atabo. The motion, marked M/16976/2024, was submitted to the court on December 19 and was heard on Monday. Following the court’s decision, a certified true copy of the order was provided to the News Agency of Nigeria (NAN) the next day.

In his application, Bodejo sought his release from the DSS detention facility until his case is adjudicated in court. He also requested the court’s permission to file a writ of habeas corpus, a legal procedure that challenges the lawfulness of his detention. Habeas corpus is a fundamental legal remedy that ensures individuals are not unlawfully imprisoned without due process.

Bodejo’s motion was filed against the Attorney-General of the Federation, Chief Lateef Fagbemi, and the DSS Director-General, Adeola Ajayi, as the respondents. He sought an interim order for his immediate release or, alternatively, for the DSS to produce him before the court while the matter was under consideration.

Justice Zubairu acknowledged that the DSS holds the authority to arrest and detain individuals as part of its mandate to maintain public order and safety. However, he underscored that such powers are bound by constitutional rights, particularly Section 35 of the 1999 Constitution, which sets a clear time limit for detention without charge—no longer than 24 to 48 hours.

In his ruling, Justice Zubairu remarked, “Courts must ensure that constitutional provisions are upheld and not violated.” He noted that Bodejo’s detention had exceeded the statutory limits. Referring to the affidavit provided by Bodejo’s wife, Hauwa Muhammad Bodejo, the judge expressed his concern over the length of his detention without trial. As a result, he granted Bodejo leave to apply for a writ of habeas corpus.

The court ordered that Bodejo’s substantive application for habeas corpus should be filed within 24 hours, allowing the court to evaluate the merits of the case. Justice Zubairu further emphasized that, in a democratic society such as Nigeria, no individual should be held in detention beyond the constitutionally mandated period without judicial oversight or a court order.

The judge also noted that Bodejo had not been brought before a court of law since his arrest on December 9, 2024.
