The plaintiff said that the defendant beat her any time she returned home late from work or when she demanded from him the payment of the money he owed her.
According to the plaintiff, the defendant beat her till she fainted on two different occasions.
Sakirat added that Hammed also neglected and maltreated their children.
The plaintiff, in addition to divorce, pleaded for their children’s custody and the responsibility of their upkeep to be placed on the defendant.
She further sought an order restricting her husband from harassing and interfering with her private life.
Hammed agreed to divorce, stating that Sakirat, apart from being arrogant and rude was also irresponsible.
He explained that she mismanaged the fund he gave her to run a business on two different occasions.
He added that she was a party freak.
According to Hammed, Sekirat would attend a party without his consent, get drunk, stagger home, and sleep outside their house.
He stated that he had endured many insults from his wife and could no longer stand it any longer.
He added that Sakirat’s drinking habit has brought him shame.
Hammmed refused that his wife be awarded custody of their children.
Sakirat said in court, “My husband daily neglects me and our children, and scaresly meets our needs.
“His way of proving that he is the head of the home is by fighting and giving me blows.
“We held an introduction ceremony after he impregnated me, and we started living together.
“I lost my peace after this.
“My husband never ceased to maltreat me.
“He did not stop beating me the three times I was pregnant.
“The more his parents called him to his senses, the worse he became.
“My husband’s maltreatment of me grew worse after we moved to our own house.
“He always complained that I returned home late from work, not minding the fact our house is far.
“Every attempt I made in letting him see reason always turned into a fight, and he would show me no mercy.
“I fainted on two different occasions as a result of the heavy blows he gave me.
“My husband also always gets angry and acts like a beast anytime I demand for the payment of the debt he owes me.
“Our children are happy when he is out of the home because he is a terror unto them.
“He shows them no love and also denies them their needs.
“My lord, I have had enough of my husband’s brutish behaviour.
“I pray that the court rules that we go our different ways, but grant me our children’s custody.
“I implore the court to make my husband responsible for our children’s upkeep.
“I further seek an order restricting him from threatening and interfering with my private life.”
Hammed responds, “My wife lacks the attributes of a virtuous woman, which is the reason we fight almost all the time.
“Sakirat is not submissive.
“She has been constantly rude to me and arrogant since the outset of our marriage and hates to be corrected.
“My wife is not industrious.
“I bought her a sewing machine to work with, but abandoned it after much complaint and failed to make a living from it.
“I gave money on two different occasions to set up a business, but she mismanaged these.
“My wife is a party freak.
“She will abandon her duties of cooking and cleaning the house and go partying.
“My wife will get drunk and stagger home.
“She will sleep outside the house when she is in this state, thus turning herself into a laughing stock in the neighbourhood.
“She also disgraces me when in this state.
“I have reported her to her parents, who counseled her, but she has failed to change.
“My Lord, I am also fed up with my wife and her indecent lifestyle.

The president of the court, Mrs S.M Akintayo, giving her judgment, stated that there was no marriage to be dissolved since no customary marriage was held between both of them. She granted the plaintiff custody of their children and ordered the defendant to be responsible for their upkeep.
